Terms of Service

1. What listmyslabs is
listmyslabs is a software service that helps trading card sellers manage their inventory, automate eBay listings, and optionally operate a public storefront to sell cards directly to buyers. By using listmyslabs you agree to these Terms of Service.
2. Your account
You must be 18 or older to use listmyslabs. You are responsible for keeping your login credentials secure and for any activity under your account. You must provide accurate information when signing up, connecting your eBay account, or setting up Stripe payments.
3. Your content and listings
You retain ownership of the cards, photos, descriptions, and other content you upload. You grant listmyslabs a limited license to display that content on our service and your connected storefront. You warrant that you legally own the cards you list and that all representations about them (grade, condition, authenticity) are accurate.
Prohibited listings: counterfeits, stolen goods, cards with altered certification numbers, cards misrepresented as to grader or grade, and anything illegal to sell under applicable law. We remove violating listings and may suspend accounts that repeatedly post them.
4. Storefront sales and Stripe
If you enable your storefront, payments are processed via Stripe Connect. You maintain your own Stripe account — listmyslabs does not touch or hold your funds. By selling through our storefront you also agree to Stripe's Connected Account Agreement.
listmyslabs collects a 6% platform fee on each storefront sale, deducted automatically at the time of payment. This fee covers payment processing and platform operating costs.
5. Subscription plans
Paid subscription plans (Starter, Pro, Elite) are billed monthly or annually through Stripe. You can cancel at any time from your account settings — your plan remains active until the end of the current billing period, after which you are downgraded to the free tier. 6. Seller responsibilities
When a buyer purchases from your storefront, you are the seller of record. You are responsible for:
- Purchasing a shipping label and handing the package to the carrier within 5 business days of a confirmed order
- Shipping the card to the buyer's provided address promptly
- Handling any returns, refunds, or disputes directly with the buyer
- Collecting and remitting any applicable sales tax
- Issuing any 1099 or tax forms required by your jurisdiction
Your eBay-configured business policies (shipping, return, payment) apply to storefront sales as well as eBay sales.
6a. Non-shipment policy & suspension
Buyers trust listmyslabs to deliver what they paid for. Sellers who repeatedly fail to ship paid orders harm that trust and will be removed from the platform.
- If an order is not shipped within 5 business days, listmyslabs may automatically refund the buyer in full, reverse the corresponding payout, and mark the order cancelled.
- Shipment is verified via carrier tracking. Buying a label without actually handing the package to the carrier does not count as shipping — the carrier's first scan is the source of truth.
- Sellers whose non-shipment rate exceeds 5% over any rolling 30-day window, or who accumulate 3 or more non-shipment incidents in any 90-day window, may have their storefront suspended without notice. Pending payouts may be held while we investigate.
- Suspended accounts lose access to the storefront, checkout, and any eBay auto-posting features. Existing paid orders must still be fulfilled or will be refunded to buyers from the seller's Stripe balance.
- listmyslabs reserves the right, at its sole discretion, to suspend or terminate any account engaged in patterns consistent with fraud, bait-and-switch, or deliberate non-shipment, even below the thresholds above.
Sellers may appeal a suspension by emailing support@listmyslabs.com with tracking numbers and any relevant context. We review appeals in good faith but the final decision rests with listmyslabs.
7. Service availability
We strive to keep listmyslabs available 24/7 but make no guarantee. We may perform maintenance, deploy updates, or experience outages. We are not liable for lost sales or damages resulting from downtime, API rate limits (from eBay or other third parties), or features that temporarily fail.
8. Termination
You can delete your account at any time by emailing support@listmyslabs.com. We may suspend or terminate accounts that violate these Terms, engage in fraud, or put the service at risk. Your storefront goes offline immediately on termination. Open orders are honored until fulfilled.
9. Legal restrictions
listmyslabs is currently available to sellers located in the United States. Buyers may purchase from supported countries: United States, Canada, United Kingdom, Australia, Germany, France, Japan, Italy, Spain, and the Netherlands. Export laws of your jurisdiction apply.
10. Liability
listmyslabs is provided "as is". We are not liable for indirect, incidental, or consequential damages. Our aggregate liability to you under these Terms is capped at the total fees you've paid us in the preceding 12 months.
11. Changes
We may update these Terms periodically. We'll notify you of material changes via email or an in-app banner at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance.
